Terms of service
These terms are an agreement between you and Kainotomic, Inc., a Delaware corporation based in Los Angeles, at 1301 North Broadway STE 32279, Los Angeles, CA 90012, United States (“Kainotomic”, “we”, “us”), for the use of Kainotomic Studio (“the Studio”). By using the Studio, you accept these terms. If you don’t accept them, don’t use it. If you use the Studio for a company, you accept them for that company, and you confirm you may do so.
Our privacy policy says how we handle data.
The service
The Studio is a video production service. You talk to an agent. It learns about your company, proposes video ideas, plans them on a calendar, makes the videos, and posts them to the accounts you connect once you approve them. It can also promote posts on Meta when you approve. The Studio is in private testing, and its features may change.
Accounts
- Give accurate, complete and current information. If you don’t, we may end your account.
- Keep your sign-in safe. You are responsible for what happens under your account.
- Tell us at once at [email protected] if you think someone else has used it.
- You must be at least 16 to use the Studio.
Your content
- What is yours. You keep your rights in the files and information you give the Studio. You own the videos the Studio makes for you.
- What you let us do. You let us store, copy, process and change your content, and send it to the providers named in the privacy policy, only to run the Studio for you. You also let us post it to the accounts you connect, when you have approved it. This ends when the content is deleted.
- What you promise. You have the rights to what you give the Studio, including footage, music, logos, and the likeness and voice of anyone in it, and to have it posted where you choose.
- AI training. We don’t use your content to train AI models.
- What is ours. The Studio, its software and its design belong to Kainotomic and its licensors. You may not copy, change, decompile or reverse engineer them.
AI-generated content
The Studio makes content with AI models. It can be wrong, incomplete, or similar to content made for others. Watch and read every video before you approve it. You are responsible for what you approve and publish, including following each platform’s rules on labelling AI content. When a video posted to YouTube contains realistic generated footage, the Studio marks it as altered or synthetic content.
What the agent does for you
- Ideas. The agent proposes ideas. A video is made only for an idea you approve.
- Posting. The Studio posts a video only after you approve it, and only to the accounts and at the times on your calendar.
- Spending. Nothing spends until you approve it. The agent proposes each promotion on a card that shows its goal, budget, days, audience and the most it can cost. It starts only when you press Approve. Resuming a paused promotion, raising its budget or giving it more days each needs your approval too.
- Spending less. The agent may pause, end or lower a promotion without asking, and tells you when it does.
- Limits. No promotion runs from an ad account until you set the most one promotion may cost there.
- Payment for ads. Ad spend is charged by Meta to your ad account. We never hold or handle that money. You are responsible for the promotions you approve and for Meta’s charges.
Acceptable use
Use the Studio only for lawful purposes. Don’t use it to:
- break any law or regulation, or anyone’s rights, including copyright, trademark and privacy;
- make content that is sexual and involves minors, harasses or threatens people, or promotes violence;
- show a real person saying or doing something they didn’t, without their consent, or otherwise mislead people;
- impersonate Kainotomic, its staff, another user, or any other person or company;
- send spam or advertising that the recipients didn’t agree to;
- break the rules of the platforms you post to;
- reach another company’s data, our keys or our systems, or get around the Studio’s limits;
- stop or hinder anyone else’s use of the Studio.
Third-party platforms
- YouTube. The Studio uses YouTube API Services. By using the Studio’s YouTube features, you agree to be bound by the YouTube Terms of Service. Google’s Privacy Policy also applies: http://www.google.com/policies/privacy.
- Meta. When you connect Instagram, Facebook or Meta ads, Meta’s terms also apply, including the Facebook Terms of Service, the Instagram Terms of Use and Meta’s Advertising Standards.
- We don’t run these platforms. They may refuse, delay, limit or take down a post or an ad, and they set limits on how much can be posted each day. We are not responsible for what they do.
Fees
Fees are the ones shown to you, or agreed with you, before you buy. We charge nothing you haven’t agreed to first.
Ad spend is separate. You approve each promotion, and Meta charges it to your ad account directly.
Disclaimer
The Studio is provided “as is” and “as available”. We make no warranties, express or implied, and disclaim all others, including merchantability, fitness for a particular purpose and non-infringement. We don’t promise that the Studio will be uninterrupted or free of errors, that its content will be accurate or complete, that a post will go out, or that a video or promotion will get any result.
Limitation of liability
To the extent the law allows:
- Kainotomic and its suppliers are not liable for any indirect, incidental, special or consequential damages arising from the use of, or the inability to use, the Studio. This includes loss of data, loss of profit and business interruption.
- Our total liability for any claim about the Studio is limited to what you paid us in the 12 months before the claim, or US$100 if you paid us nothing.
Ending your use
- You may stop using the Studio at any time, and ask us to delete your company’s data.
- We may suspend or end your access if you break these terms, give inaccurate information, or put the Studio or other users at risk.
- When your use ends, the Studio stops posting and promoting for you, and we delete your data as the privacy policy says.
- The sections on your content, disclaimer, limitation of liability and governing law continue after your use ends.
Governing law
These terms are governed by the laws of the State of California. Any dispute about them or the Studio goes to the courts in Los Angeles County, California.
Changes to these terms
We may change or replace these terms at any time. For a material change, we will try to give at least 30 days’ notice before the new terms take effect. If you keep using the Studio after that, you accept the new terms.
